These Terms of Service ("Terms") govern access to and use of Hourbooks, a billing, invoicing and client management platform operated by Hour Glass Solutions (Pty) Ltd ("Hour Glass Solutions", "we", "us"), a company registered in the Republic of South Africa. By creating a workspace or otherwise using Hourbooks, you agree to these Terms on behalf of yourself and, where applicable, the business you represent ("you", "your company").
Hourbooks provides tools for quotes, invoices, proformas, credit notes, delivery notes, client and supplier records, bank reconciliation, recurring billing, purchase orders and related reporting. We may add, change or remove features from time to time as the product evolves. We'll do our best to give notice of changes that materially reduce functionality you rely on.
Each Hourbooks workspace belongs to the company or individual that created it. You're responsible for the accuracy of information you enter, for keeping login credentials confidential, and for all activity that happens under your account. If you believe your account has been accessed without authorisation, contact us immediately.
You must be lawfully authorised to act on behalf of the business you're setting up a workspace for. We reserve the right to suspend a workspace where we reasonably suspect fraud, abuse, or unlawful use.
Hourbooks is offered on paid monthly subscription plans (Starter, Growth, Business), each with its own feature set and pricing as published on our pricing page. New workspaces begin with a 14-day free trial with full access to the features included in the selected plan; no card is required to start a trial.
Where you subscribe to a paid plan, billing is processed by our third-party payment processor, PayFast (Pty) Ltd, on a recurring monthly basis until you cancel. Prices are in South African Rand (ZAR) and may include applicable VAT. We may change subscription pricing with reasonable advance notice; continued use after a price change takes effect constitutes acceptance of the new price.
Upgrading to a higher plan takes effect immediately, with the new plan's features unlocked right away and billing adjusted accordingly. Downgrading to a lower plan takes effect at the start of your next billing cycle, so you keep what you've already paid for until then.
You may cancel your subscription at any time from your workspace billing settings. Cancellation stops future billing but does not automatically entitle you to a refund of amounts already paid for the current billing period, except where required by law. If you believe you've been billed in error, contact us and we'll investigate promptly.
You retain ownership of the business, client and financial data you enter into Hourbooks. We process that data to provide the service to you and do not sell it. Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
You're responsible for the accuracy and lawfulness of the data you upload, including any personal information about your own clients, employees or suppliers that you choose to store in your workspace.
You agree not to use Hourbooks to store or transmit unlawful content, to attempt to access another workspace without authorisation, to interfere with the platform's normal operation, or to use the service in a way that breaches South African law, including data protection and consumer protection legislation.
We aim to keep Hourbooks available and reliable, but we don't guarantee uninterrupted access. Planned maintenance, third-party outages (including our hosting provider or payment processor) or circumstances outside our reasonable control may affect availability from time to time.
To the extent permitted by law, Hour Glass Solutions' total liability arising from or related to your use of Hourbooks is limited to the fees you paid for the service in the three months preceding the claim. We're not liable for indirect or consequential losses, including lost profits or lost data, except where such exclusion is not permitted by law.
You may stop using Hourbooks and cancel your workspace at any time. We may suspend or terminate a workspace that breaches these Terms, with notice where reasonably possible. On termination, we'll retain your data for a reasonable period to allow export, after which it may be deleted in line with our data retention practices.
We may update these Terms from time to time. Where changes are material, we'll make reasonable efforts to notify account owners. Continued use of Hourbooks after an update takes effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
Questions about these Terms can be sent to thuthukani@hourglasssolutions.co.za, or by post to Hour Glass Solutions (Pty) Ltd, South Africa.
